1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Facts of recognition;

A. 1) The Defendant, under the trade name of “C,” registered his/her business on March 10, 2007; the location of his/her place of business is “Seoul-gun D, Gyeong-gun;” and registered his/her business under the name of “Seoul-gun, Gyeong-gun; and thereafter, the Defendant changed its trade name into “C” on May 24, 201.

(2) The Plaintiff established “A” and appointed its representative director, and completed the business registration under G name on June 8, 201, with the type of the business as a mail-tight food, etc.

On September 201, the Defendant came to know the Plaintiff through the introduction of the land manager around the end of September 201, and thereafter G was supplied with cold and hot water and boomed by the said company while engaging in transactions with H.

3) After closure of H’s business with financial standing, etc., H was no longer able to supply products to G. The Plaintiff and the Defendant together with the business that produces products in G, and concluded an agreement with the Defendant to establish a factory located in the Y-gun and the Plaintiff to manufacture the products. (B) On February 2012, the Defendant completed the construction of the factory located in the Y-gun and the relocation of the factory located in the Y-gun into the Y-gun-gun. (33,214,00 won in total, including the 33,214,000 won in the Y-gun-gun’s income support project and the 133,214,000 won in the Y-gun’s income support project in the name of the Y-gun-gun Agricultural Partnership. (3) On May 2012, the Defendant completed the construction of the factory located in the Y-gun-gun-gun around 2012.

2) After that, even though he/she applied for permission to use the factory for the operation of the factory, the permission was not granted for the reason that the sanitary facilities were not installed, and the above factory could not be operated actually.

The defendant is supported by the Colonel-gun around May 2013.
