A defendant shall be punished by imprisonment for one year.

The defendant shall pay 10,390,000 won to the applicant for compensation. The above compensation order shall be issued.

Punishment of the crime

"2017 Highest 8491"

1. 피해자 B에 대한 사기 피고인은 2017. 4. 경 인터넷 게임을 하면서 피해자 B을 알게 되었고, 피해자에게 사귈 것처럼 거짓말하고 돈을 빌리기로 마음먹었다.

On May 20, 2017, the Defendant told the victim at an insular place C that “Grain Doctrine should go to the hospital, and lend hospital expenses to the hospital.”

However, the defendant did not have any intention or ability to repay even if he borrowed money from the injured party due to the absence of certain income at the time.

As such, the Defendant, by deceiving the victim, received KRW 200,00 from the victim to the bank (E) in the name of the Defendant on the same day from the victim, and by deceiving the victim as indicated in the list of crimes in the attached Table from the date and time to June 2, 2017, received KRW 14,210,000 in total once from the victim.

Accordingly, the defendant was given property by deceiving the victim.

2. Fraud against victim F;

A. On July 8, 2015, the Defendant: (a) at the victim F’s house located in G Building H at Sinpo City G Building H, “The Defendant used a mobile phone under the current name of the same student, but did not good, left the same after the birth was terminated; (b) the Defendant would pay the mobile phone price and the fee for the mobile phone use inside the main line by opening the mobile phone under four names.

However, the defendant did not have any intention or ability to pay the charge even if he/she received a cell phone opened from the injured party due to the lack of import.

Nevertheless, the Defendant: (a) by deceiving the victim and deceiving the victim as above, received the victim’s cell phone (I) from the victim; and (b) around that time, received the victim’s cell phone (I); and (c) obtained profits equivalent to KRW 3,365,730, including but not limited to KRW 781,686, small-sum settlement use fee 2,30,000, usage fee 284,044.

B. On August 20, 2015, the Defendant entered in the preceding port at around 14:00.
