A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is “C” DJ, the operating space of private play equipment, and the victim D (name, leisure, age 19), victim E (name, age 20), victim F (age 20), and victim F (age 20) are customers of “C”.

1. 피해자 D에 대한 범행 피고인은 2018. 3. 26. 18:11 ∼18 :22 경 청주시 상당구 G에 있는 ‘C’ 내 디스코 팡팡 놀이기구에서, 위 기구가 회전하는 동안 피해자가 몸을 제대로 가누지 못하는 것을 기화로 강제 추행할 것을 마음먹고, 피해자에게 다가가 앉아 있는 피해자의 허벅지를 손으로 쓸 듯이 1회 만지고, 계속하여 기구가 위아래로 튕기듯 움직이면서 피해자의 엉덩이가 번쩍 들릴 때 피해자의 치마 속으로 손을 집어 허벅지 안쪽을 수차례 만지고, 계속해서 앉아 있는 피해자의 허벅지를 두 손으로 잡고 끌어내리고, 손으로 피해자의 엉덩이를 꼬집는 등 피해자를 강제로 추행하였다.

2. 피해자 E에 대한 범행 피고인은 전항 기재 일시, 장소에서 같은 방법으로 놀이기구가 회전하는 동안 앉아 있는 피해자의 허벅지를 손으로 쓸 듯이 1회 만지고, 계속하여 손으로 종아리 부위를 잡아 끌어내리려고 하고 기구가 튕길 때 다리가 들리자, 피해자의 허벅지 위를 찰싹 때리거나 허벅지 안쪽을 만져 피해자를 강제로 추행하였다.

The Defendant committed the crime against the victim F in the same manner and at the time and place set forth in the preceding paragraph, and committed an indecent act by force against the victim by making it possible for the victim to use the victim’s buckbucks in hand. On the part of the victim’s left bucks, the victim’s left bucks were cut down by two hand, and the victim’s left bucks were stored in the victim’s left bucks.
