A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
[Violation of the Labor Standards Act] The Defendant is an employer who ordinarily employs approximately 55 workers while operating AE in Gangseo-gu Seoul Metropolitan Government AD.
The victim AF is working for the above company from July 1, 2008 to January 25, 2011.
The defendant retired from office without having agreed on the extension of the payment date, and the defendant did not pay 18,977,454 won of wages and retirement allowances to him within 14 days from the date of his retirement.
In addition, the Defendant did not pay the wages and retirement allowances of KRW 146,485,834 (the total amount of KRW 23 and the total amount of KRW 164,68,377, but the total amount of KRW 18,182,543 was deducted from two workers dismissed in the order) for total of 21 workers as indicated in the attached list of crimes in the attached list of crimes.

1. The Defendant violating the Labor Standards Act with respect to AE workers is the representative director of AE in Gangseo-gu Seoul Metropolitan Government, who has been engaged in clothing distribution business using approximately fifty-five regular workers.
The Defendant, at the foregoing workplace, did not pay the total amount of KRW 181,748,193 (the total amount of KRW 43,258,738,106, but the total amount of KRW 15,76,989,913, which was dismissed in the order was deducted from the date of payment) to 28 workers, including the total amount of wages and retirement allowances, from June to July 27, 2011 to 4,352,567 won, to 20 workers from January 26, 2011 to July 27, 2011.
2. (State) The Defendant violating the Labor Standards Act for AH workers is the representative director of AH in Yongsan-gu Seoul, Yongsan-gu, Seoul, who has been engaged in clothing wholesale and retail business using 50 full-time workers.
The defendant has worked for AH store located in Gangseo-gu Seoul Metropolitan Government, AH store from October 1, 2006 to January 31, 2010.
