Reasons
Punishment of the crime
1. No person who violates the Electronic Financial Transactions Act shall borrow or lend a means of access for electronic financial transactions, or keep and deliver a means of access, knowing that such act is intended to use it for a crime or is to be used for a crime;
Nevertheless, on October 2019, the Defendant accepted the proposal that “after receiving the check from a third party, the Defendant would pay 1% of the amount of the withdrawal as allowances if he withdraws and transfers the money deposited into the account linked to the card after receiving the check from the third party.”
D A. On October 14, 2019, the Defendant received an order from a scaming staff member on the above name in the name of the Defendant from a scaming supervisor on the non-scam and received a scam card from D in front of the Dong Government E Apartment Fdong on the same day from D at around 19:00 on the same day, and received one copy of the G bank cam card (H) in the name of the Dong at the above location.
Accordingly, the Defendant knowingly received and kept a means of access for electronic financial transactions.
B. On October 15, 2019, the Defendant received an order from an employee operating the above name scaming in the name of the Defendant at the scam in the name of the Defendant: (a) issued a copy of the K bank cream card (L) in the name of the Defendant at the scam of the same day at around 14:25 on the same day.
Accordingly, the Defendant knowingly received and kept a means of access for electronic financial transactions.
C. On October 15, 2019, the Defendant received one copy of the G Bank's physical credit card in the name of M from M on the roads front of the O's neighboring P convenience point, following the instruction from the Defendant, who was instructed by Singishing staff on the above name in the name of M to “Sing off to N in Hongcheon-gun N and receiving the C-C-C-C-C-C-C-C-C-C-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-
Accordingly, the defendant can be used for crime.
