1. As to KRW 64,50,000 and KRW 34,500,00 among them, the Defendant shall pay to the Plaintiff the year from March 31, 2014 to April 18, 2019.

Facts of recognition

Around February 27, 2013, the Defendant borrowed KRW 30 million from the Plaintiff, and the Plaintiff borrowed KRW 30 million from the Plaintiff around February 27, 2013. On February 27, 2013, the Defendant prepared and issued a written confirmation stating that “The amount of KRW 30 million was confirmed to have been deposited in the Defendant, Nonghyup Bank Co., Ltd.”.

Around September 18, 2012, the Defendant: (a) carried a vehicle owned by the Plaintiff into D Co., Ltd.; and (b) subsequently, around October 2013, the Plaintiff sold the vehicle to the Defendant with a purchase price of KRW 140 million; and (c) the Defendant prepared and issued to the Plaintiff a written confirmation stating that “the purchase price of KRW 34.5 million shall be paid as of March 30, 2014,” according to the settlement of the purchase price.

[Reasons for recognition] In light of the facts without dispute, Gap evidence Nos. 1 and 2, the fact finding results of this court's fact finding against D Co., Ltd., and the fact finding as above, the defendant is obligated to pay to the plaintiff 64.5 million won, including loans of 30 million won and remaining purchase and sale of vehicles 34.5 million won, and 34.5 million won from the day following the delivery date of the vehicle after delivery, the remaining purchase and sale price of the vehicle from March 31, 2014 to April 18, 2019, the delivery date of the copy of the complaint of this case, 5% per annum under the Civil Act, and 12% per annum from the day following the day of the next completion date until the day of the payment of the complaint of this case, to the day of the payment of 30 million won per annum, and to the day of the payment of 20.5% per annum interest per annum from the day after the above notice of the complaint of this case to the day of 20.
