A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall distribute or provide for use any game product, the rating of which is denied because it falls under the speculative game products, and shall engage in speculative activities as a business using speculative gaming machines.

피고인은 2015. 10. 16. 경부터 2015. 10. 22. 경까지 사이에 거제시 C 지하 1 층에서 게임 물관리 위원회로부터 등급 분류가 거부된 사행성 유기기구인 야마 토 게임기 10대, 정글북 게임기 5대를 설치해 놓고 불특정 손님들에게 제공하여 이를 이용한 손님들 로 하여금 10,000 원권 지폐를 게임 기 안에 넣고 시작 버튼을 눌러 베팅을 하게 하고, 화면 상의 그림이나 숫자가 돌아가다가 멈췄을 때 그림이나 숫자의 가로, 세로, 대각선의 배열이 일정한 규칙에 따라 일치되면 점수를 획득케 하여 1점 당 5,000원으로 환산해 환전 수수료 10%를 제하고 4,500원을 손님들에게 주는 방식으로 환전 영업을 하였다.

As a result, the Defendant committed an act of providing speculative game water for which the classification of class is refused, and committed a speculative act that causes property benefits or losses to customers by using speculative gaming machines.
