1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. According to the facts that there is no dispute over the cause of the claim, Gap evidence Nos. 1, 3, 4, Eul evidence Nos. 1 and 12 (including paper numbers), and Eul's witness's testimony, the defendant may recognize the fact that the plaintiff occupies a part of the attached Form No. 15, 16, 17, 18, and 15 (hereinafter referred to as "the occupied part of this case") among the land No. 15, 16, 17, 18, and 15 of the land No. 2467.8 square meters (hereinafter referred to as "the land No. 15, 16, 17, 18, and 15 of the land No. 246.89 square meters (hereinafter referred to as "the occupied part of this case") on the ground of the attached Form No. 1, 2, and 3 of the container No. 5, and the remaining testimony of the witness C
Therefore, barring any special circumstance, the defendant is obligated to remove each of the above container stuff structures and deliver the occupied part of this case to the non-party company, and the plaintiff who has the right to claim ownership transfer registration against the non-party company upon termination of the trust with the non-party company needs to make the claim of this case
2. Defendant’s defense
A. The defendant raises a defense to the effect that he occupies the land of this case as the lien holder.
Comprehensively taking account of the overall purport of the pleadings in each statement or image of evidence Nos. 1, 2, 4 through 6, and 8 through 12 (including household numbers), the Defendant: (a) determined the construction period between April 23, 2012, and April 22, 2012, to July 22, 2012, the construction work of the instant land was contracted; (b) the construction work of the factory site for the instant land was extended on July 20, 2012 from April 23, 2012 to December 31, 2012; and (c) concluded a contract for the alteration of the construction cost to KRW 10,1460,00,000,000, including the aforementioned contract, by the Defendant from April 23, 2012 to December 31, 2012; and (d) concluded the contract for the alteration of the construction cost to KRW 110,460,00,00.
