1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On July 6, 1973, while serving in the Army, the Plaintiff was injured on April 4, 1976 that the right-side 5 balance was stored in the reading house. On June 22, 1976, the Plaintiff discharged from military service on June 22, 1976.
B. On August 18, 2008, the Plaintiff applied for registration of a person of distinguished service to the State (hereinafter “the instant wound”) with a wound from the Defendant (the head of Msan veterans branch at the time of military service) on the ground that “the Defendant was treated by suffering from a wound with the right 5 snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick snick sn.”
C. Accordingly, the Plaintiff was subject to a new physical examination on December 22, 2008 and a re-verification physical examination on October 12, 2010, but was judged to fall short of the grading standard.
After that, on October 16, 2012, the Plaintiff filed an application for re-verification of the instant wounds with the Defendant, and the Defendant, following deliberation by the Board of Patriots and Veterans Entitlement, acknowledged the instant wounds as one of the requirements of Article 2(1)2 of the Act on Support for Persons Eligible for Veteran’s Compensation (hereinafter “the Veterans’ Compensation Act”) on April 2, 2013.
E. On April 22, 2013, the Plaintiff received a re-verification physical examination of the instant wounds, but was determined below the classification standard, and accordingly, the Defendant rendered the instant disposition against the Plaintiff on June 7, 2013, stating that “The Plaintiff was determined to fall short of the classification standard as a result of the physical examination of the classification of disability grades and was determined to be ineligible for the application of the Patriots and Veterans Compensation Act.”
