The sentence of sentence against the defendant shall be suspended.

Punishment of the crime

The Defendant is the chairperson (from January 19, 2013 to January 31, 2017) of the Gyeonggi-do Association C (hereinafter referred to as the “C”) of the Korean Association of Deaf-do (hereinafter referred to as the “C”), an incorporated association, and is a local assistant business operator who receives local subsidies from the Gyeonggi-do D market to carry out the project for the “voluntary sign language class” to train specialized sign language interpreters and sign language interpreters through sign language education.

A local subsidy program operator shall faithfully perform a local subsidy program with the care of a good manager in accordance with statutes, the details of the decision to grant local subsidies, or the disposition by the head of a local government under statutes, and shall not use the relevant local subsidy for other purposes

Nevertheless, the Defendant, while holding a concurrent office of C and D, applied for local subsidies from D market to use the “voluntary sign language class” project costs for the said project, and received lecture fees from D market to C’s account, and paid lecture fees again from C’s staff to C’s office operating expenses. On March 25, 2013, the Defendant paid KRW 120,000 among the local subsidies that were received from D city for the purpose of tuition expenses, to E’s office operating expenses, and paid KRW 120,000 among the local subsidies that were received from D city for the purpose of tuition expenses. From around April 12, 2013 to December 23, 2016, the Defendant received KRW 120,000 from C’s account as KRW 120,00,000 from C’s office expenses, etc., and received KRW 30,000,000 from C’s office expenses, and paid KRW 30,007,000 from C’s local office expenses.

Accordingly, the defendant used local subsidies for other purposes as a local subsidized project operator.
