1. The defendant shall be punished by imprisonment for a period of two years and six months;

가. 피고인은 2013. 여름 무렵 어느 날 12:00경 안산시 단원구 C에 있는 피고인의 집에서 자신의 친딸인 피해자 D(여, 10세)을 안방으로 들어오게 한 다음, ‘찌찌 따먹어야지.’라고 말을 하며 피해자의 상의를 위로 걷어 올리고 자신의 양손을 피해자의 상의 안으로 집어넣어 가슴을 주무르고, 입으로 가슴을 핥고, 손으로 피해자의 음부 부위 공소장에는 ‘음부’라고만 되어 있으나, 이 법원이 채택조사한 증거들에 의하면 피고인이 피해자의 음부 그 자체를 만졌다고 단정하기는 어렵고, 옷 안이나 옷 밖으로 음부 또는 그 주변 부위를 만진 것으로 보이므로, 이와 같은 내용을 포괄하는 의미에서 ‘음부 부위’로 변경하여 인정하기로 한다.
