A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On March 15, 2013, the Defendant was sentenced to a fine of 5 million won for a violation of the Road Traffic Act (driving) in the Suwon District Court's Ansan Branch on March 15, 2013, and a fine of 10 million won for a violation of the Road Traffic Act (driving) in the Ansan District Court's Ansan Branch on May 31, 2013 and two or more occasions of force.

1. Around 01:45 on February 21, 2013, the Defendant was driving a B K5 vehicle under the influence of alcohol level of about 0.147% in the section of about 1km from the front side of the Korea University Hospital within the city of Ansan-si to the front side of the grassland, sports ground, and distance.

2. 도로교통법위반(음주측정거부) 피고인은 2013. 3. 28. 02:45경 안산시 단원구 C 앞길에서, 음주운전으로 의심되는 사람이 차량 안에서 잠을 자고 있다는 112신고를 받고 출동한 D파출소 소속 경사 E 등 2명이 차안에서 시동을 켠 상태로 잠을 자고 있던 피고인을 상대로 음주여부 등을 확인하기 위해 대화를 한 바, 입에서 술 냄새가 나면서 얼굴의 혈색은 붉고 발음은 꼬였으며 보행상태는 비틀거리는 등 음주상태로 운전하였다고 인정할 만한 상당한 이유가 있어 E으로부터 약 30분간에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았다.

Nevertheless, the defendant avoided this and did not comply with the police officer's request for a drinking test without any justifiable reason.
