A defendant shall be punished by imprisonment for not less than three years and six months.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

1. On October 13, 2015, at around 23:00, the injured Defendant: (a) provided that at “D main points” located in Dongdaemun-gu Seoul Metropolitan Government, the victim E (n, 57 years of age) and the first drinking drinking water would drink with drinking water; (b) together, on October 14, 201:00 of the same month, the injured Defendant would take the victim’s house in front of “G hotel” located in the same Gu F, while getting a taxi and getting a taxi into and out of the taxi, she set up a taxi in front of the “G hotel” located in the same Gu; (c) forced the victim to move out of the floor; and (d) led the victim’s hand to the said telecom.

” 라는 말과 욕설을 하며 휴대폰을 쥔 주먹으로 피해자의 얼굴을 수회 세게 때려 바닥에 쓰러뜨리고, 계속하여 피해자를 일으켜 세운 후 신발도 신지 못한 피해자의 손을 잡아 위 모텔 쪽으로 끌고 가려 다 피해 자가 이를 뿌리치며 도망가려고 하자 손으로 피해자의 얼굴을 때리고, 발로 배를 차고, 손으로 가슴을 밀쳐 다시 바닥에 쓰러뜨린 후 그 상태에서 손으로 피해자의 뺨을 꼬집고 때리며, 여러 차례 머리채를 잡고 흔들어 피해자가 그로 인하여 정신을 잃었음에도 계속하여 피해자의 머리 부분을 발로 걷어 참으로써 피해자에게 약 2 주간의 치료가 필요한 두개 내 열린 상처가 없는 뇌진탕 등 상해를 가하였다.

2. A quasi-indecent act: (a) the Defendant forced the victim to commit assault as set forth in paragraph (1) and lost the mind of the victim; (b) opened the victim’s face on his bucks; (c) taken the victim’s face on the victim’s face; (d) taken the victim’s face; and (e) taken the Defendant’s face on the victim’s face; and (e) taken the police officers assigned to the Seoul Eastdong Police Station Haba, Seoul, who received 112 reports, taken the victim’s face, and took the victim’s face on the victim’s face.

Accordingly, the defendant committed an indecent act against the victim by using the victim's resistanceable condition.
