A defendant shall be punished by imprisonment for not less than two years and six months.

Of the facts charged in the instant case, each private document in the name of D is forged.

1. Forgery of private documents;

A. On November 30, 2011, the Defendant, at the mobile phone agency of the Defendant’s operation on the first floor of the Seocho-gu Seoul Metropolitan Government H shopping mall, entered “I” in the name column of service contract without authority, “I” in the resident registration number column as “I”, and forged a new service contract in the name of I, a private document on the rights and obligations of the Defendant.

B. The Defendant, without authority, entered “I” and “J” in the name column of the sales contract form for a device to be exercised at the above temporary location, entered “I” and “I” in the resident registration number column as “J,” and forged one copy of the sales contract for a device in the name of “I”, which is a private document on the rights and obligations of the applicant’s customer column.

2. At the above temporary location, the Defendant: (a) delivered a forged new service contract and a copy of a sales contract to the employees under the name of the employees under the supervision of the company, as if the contract was duly formed; and (b) exercised the said contract.

3. Fraud;

A. At the above temporary location, the Defendant: (a) by deceiving the victim I, as if the victim I applied for the mobile phone membership of the said Scomcom staff; and (b) by allowing the victim I to open the two mobile phone units (K and L) in the first name; and (c) by imposing the victim a fee for the use of the mobile phone and the amount equivalent to KRW 2,110,570 on the victim, the Defendant acquired property benefits equivalent to the same amount.

B. On July 17, 2012, the Defendant is provided with a mobile phone with a business registration certificate that: (a) around July 17, 2012, at the M(name BZ) office located on the first floor of the Seocho-gu Seoul Metropolitan Government H shopping mall; and (b) the employees of the Kimpo Airport located within the company’s “in-house” to the victim N lose the mobile phone and compensate for damages of two to thirty million

It is 25% of the value added tax, including the value added tax, from the total sales after being supplied with a mobile phone with a business registration certificate.
