The prosecution of this case is dismissed.

1. Defendant A, in the facts charged, operates a cpherb in the second floor of the building located in Jung-gu Incheon Metropolitan City, with the trade name “C”, and the victim D (n, 41 years old) operates a cpherbb in the name of “E” on the first floor of the same building.

The Defendant insulting the victim seven times in total from September 7, 2012 to October 21 of the same year as follows.

1. At around 03:00 on September 7, 2012, the Defendant publicly insultingd the victim D with “E” for the same type of business as “G” in the body of the victim D, on the ground that the victim D had opened a house of hin with one another, on the ground that the victim D had a house of hin in the body of the Defendant.

2. On September 10, 2012, around 03:30 on September 10, 2012, the Defendant openly insulting the victim by referring to “balthing” and “balthing” while the employees, customers, etc. of the business place are hearing for the same reason at the said place.

3. On October 10, 2012, around 20:45, the Defendant made a public insult of the victim by referring to “balthing” and “balthing” while the employees, customers, etc. of a business establishment and other persons are hearing for the same reason at the same place.
