Punishment of the crime

On August 11, 2016, at around 01:20, the Defendant committed an indecent act by force against the victim E (Inn, 37 years of age, household name) following the victim E (inn, 37 years of age, and household name) who had danced at the “Dye” test in Seo-gu, Seo-gu, Gwangju, by closely exposing his body, and by doing dancing.

D나이트 CCTV 녹화영상 저장 CD의 영상 [피고인의 행위, 피해 내용, 피해자의 느낌과 반응, 범행 전후의 상황에 관한 피해자의 진술이 일관되고 구체적이다. 이 사건으로 피고인을 처음 알게 된 피해자가 무고나 위증의 벌을 감수하면서까지 피고인을 형사처벌의 위험에 빠뜨릴 의도로 거짓말을 할 이유가 없는 등 그 진술에 허위가 개재되었다고 볼 만한 사정이 전혀 없는데다가, 피해자의 법정에서의 자연스럽고 꾸밈없는 진술 태도를 더해보면, 피해자의 진술에 충분히 믿음이 간다. 바로 옆에서 범행을 목격한 F의 진술도 공소사실에 부합한다. D나이트 CCTV에 촬영된 영상 네 번째 영상 시작부터 1분 40초까지 을 보면 다음과 같은 사실을 확인할 수 있다. ① 친구 사이인 피해자 일행은 5명(여자 2명, 남자 3명 으로서 당시 D나이트클럽의 무대에서 원 모양으로 둘러서 춤을 추는 등 계속하여 팔을 뻗으면 옆 동료와 닿을 정도의 거리를 두고 뭉쳐 있었다.
