Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On March 8, 2019, at around 02:50, the Defendant committed an indecent act against the victim’s will in a forced way against the victim’s will by using and rhying the bridge of the victim D (a person, a person, and 22 years old), which is dancing at the C clubs located in Mapo-gu Seoul Metropolitan Government, as his hand.

In the statement of the victim written D (tentative name) written by the defendant and his defense counsel, the defendant and his defense counsel denied the crime, stating that " although the defendant had a fact that the defendant had dancing at the time of the instant case and had the victim's body mouth with his/her hands, it is not clear that the victim's bridge is used as his/her hand as his/her hand, such as the statement in the facts charged."

However, in full view of the following circumstances revealed by the evidence duly adopted and investigated by this court, it is recognized that the accused committed an indecent act against the victim as stated in the facts constituting the crime in the judgment of the court.

- The victim, from the investigative agency to this court, had been able to deal with sprinks, to the nearest part of the victim's sprinks. The victim immediately resisted the Defendant's hand. The Defendant first denied the Defendant's hand, and subsequently caused the Defendant's mistake. In doing so, the Defendant went back outside the club, and the Defendant was knee and kneeled, even though the Defendant did not knee. Nevertheless, the Defendant reported his indecent act to the police as if the indecent act was not different. Nevertheless, the Defendant reported his indecent act to the police, and made a consistent statement on the method of the indecent act, the victim's act corresponding to the indecent act, the victim's emotional conduct, the appraisal, and the circumstances after the indecent act, etc.

- After the victim's physical contact, the victim immediately landed from the Switzerland and resisted the defendant, and reported the fact of damage caused by an indecent act to the police, and the defendant is the victim's resistance.
