1. The Defendants are jointly and severally liable to the Plaintiff for KRW 103,086,302 and KRW 66,086,302, out of the above amounts.

Description of Claim

Under Defendant B’s joint and several sureties, the Plaintiff paid contract deposit amounting to Ulsan Construction Co., Ltd. on July 21, 2006 and Jun. 3, 2009 KRW 37,000,000 and advance payment amounting to KRW 66,086,302 paid to Ulsan Construction Co., Ltd. on September 30, 2009 under the guarantee loan limit agreement concluded with the Defendant on November 26, 2009 (a non-litigation following the submission of written reply) Articles 208(3)1 and 257(1) of the Civil Procedure Act of applicable provisions for the claim for indemnity against the Defendants relating to the amount of KRW 6,086,30 (a) (a non-litigation following the submission of written reply).
