피고인은 2013. 9. 22. 02:30경 고양시 일산서구 C빌라 앞길에서, 피고인이 타인의 주거지를 엿보았다는 이유로 112 신고를 받고 그 곳에 출동한 경기일산경찰서 D지구대 소속의 경찰관인 피해자 E으로부터 현행범으로 체포를 당하게 되자, 함께 출동한 경찰관 F 등 4명과 동네주민 10여명이 듣고 있는 가운데 공연히, 피해자에게 ‘건수를 채우려고 그러느냐, 가만두지 않겠다, 개새끼야’라고 공연히 고함을 치고, 계속하여 2013. 9. 22. 03:20경 경기일산경찰서 D지구대에서, 위 지구대 소속의 경찰관 G 등 5명과 H, I 등 다수인이 듣고 있는 가운데 공연히 ‘건수를 채우려고 그러느냐, 씨발, 짭새 새끼야, 개새끼야’라고 고함을 쳐 피해자를 모욕하였다.
