1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. On September 20, 1985, the Plaintiff entered the Gun and is currently serving as the head of the work team for the supply and transportation of the Gun Support Team B, which is currently engaged in the supply and transportation of the Gun Support Team B.

B. On December 19, 2017, the Defendant: (a) recognized the facts of disciplinary action against the Plaintiff that “the Plaintiff, a subsequent noncommissioned officer, engaged in abusive and verbal abuse; (b) instructed the Plaintiff to drive his/her own or his/her leg; and (c) during training under the influence of alcohol, he/she violated the duty to maintain the dignity and the duty of good faith; and (d) taken a seven-day disciplinary measure against the Plaintiff.”

C. On January 15, 2018, the Plaintiff appealed to the Field 3 Commander.

On July 30, 2018, the Appellate Forces Disciplinary Appeal Review Committee rendered that among the facts suspected of the above disciplinary action against the Plaintiff, the remainder of the facts suspected of the disciplinary action, other than the facts suspected of the following disciplinary action, does not constitute grounds for disciplinary action. On July 30, 2018, the following facts of the suspicion of the disciplinary action (hereinafter referred to as “suspect of the disciplinary action”) reduced the 7 days period for the above suspicion of the disciplinary action, thereby changing the disciplinary action

(이하 위와 같이 견책 처분으로 변경된 내용의 징계처분을 ‘이 사건 처분’이라 한다). 징계처분대상자는 2016. 하반기 혜산진 사격장에서, 최정예 전투요원 선발에 참여하던 피해자 하사 C가 사격을 통과하지 못하였고 또 사대를 이용하라는 본인의 말을 듣지 않았다는 이유로 위 피해자에게, 사격 중에는 “병신새끼 그것밖에 못 쏴”, “너 합격 못 하면 죽을 줄 알아”, “나와봐 내가 쏴도 그것보다 더 잘 나오겠다.”, “이 병신새끼야 그것도 못 쏘냐”, “씨발새끼, 내가 이용하라니까. 하여간 진짜 사격도 어지간히 못 하네”, 탈락 후 위로를 받는 위 피해자에 대하여는 “사격을 뭘 잘하긴 잘해, 병신새끼”라고 하고, 탄피를 반납하러 가는 위 피해자에게 “병신새끼”라고 크게...
