A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

On July 13, 2012, the Defendant was sentenced to six years of imprisonment for special robbery in the Daejeon District Court, and completed the execution of the sentence in the Daejeon Prison on April 26, 2018.

Criminal facts

[2018 Highest 4136] On November 6, 2018, the Defendant was provided with property equivalent to KRW 10,000,00, total market price of meals, liquor, etc., on the following grounds: (a) around November 22, 2018, at the D cafeteria operated by the victim C; and (b) even when ordering alcoholic beverages, it was done as if he did not have an intent or ability to pay the price; and (c) even when he did so, the Defendant was provided with property from the victim, such as meals

From that time to November 15, 2018, the Defendant received property or acquired property gains in total equivalent to KRW 994,900 in 11 times as stated in attached Table (i).

[2018 Highest 4303] On November 3, 2018, the Defendant was provided with alcohol and alcohol equivalent to KRW 39,900,00, total market price of the victim F in Daejeon-gu, Daejeon-gu, Daejeon-gu, and the Defendant was provided by the victim as if he had no intent or ability to pay the price despite the order of food.

In addition, the Defendant, from that time until November 6, 2018, received property equivalent to KRW 114,900, by deceiving the victims, respectively, three times in total, as described in the attached list of crimes.

Around 01:00 on November 2, 2018, the Defendant: (a) committed as if the Defendant would normally pay the amount of money despite having no intent or ability to pay the said amount even if the Defendant was provided with accommodation; (b) was provided as if the Defendant would normally pay the said amount; and (c) was provided as if the Defendant would receive the said amount of money from the victim in the amount of 5,000 won in total the market price; and (d) obtained the pecuniary benefits equivalent to KRW 5,000 in food and accommodation amount of KRW 60,000 in the amount of money for accommodation.
