A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Although the Defendant was not a narcotics handler due to the shipbuilding of Chinese nationality, he dealt with the Metepha (one philopopon; hereinafter referred to as “philopon”) which is a local mental medicine as follows.

1. On December 26, 2015, the Defendant: (a) transferred KRW 600,000 from C to his account, upon request from C and D, with a request to seek a phiphone at a closed place; (b) around that time, the Defendant sold approximately 0.6 g of the phiphone, which he had sought, to D around Guro-gu Seoul Metropolitan City E.

2. On March 4, 2018, the Defendant: (a) transferred KRW 1.50,000 to the account used by F from a closed place; (b) around that time, the Defendant purchased approximately 0.3g of phiphones from F at the Defendant’s home located under Guro-gu Seoul Metropolitan Government G’s house.

3. Medication of phiphones.

A. On May 2016, the Defendant conspireds with H to administer phiphones, and administered them by taking approximately 0.1g of phiphones from the Defendant’s home located near Guro-gu Seoul Special Metropolitan City I on the instrument made of a raw disease, and by taking the balon’s bottom by taking the balon on the instrument made of a raw disease.

B. The Defendant, along with F, conspiredd to administer philophones, and administered them in a way that the Defendant inhaled approximately 0.15g of philophones purchased from the Defendant’s office located under G in Guro-gu Seoul Metropolitan Government, on the apparatus made up of a raw disease, from among the philophones purchased from the Defendant’s office located under G around the middle of March 4, 2018, and inhales the smokes generated by heating the bottom of the philobs.
