Reasons
Punishment of the crime
[criminal history] On September 12, 2013, the Defendant was sentenced to one year of imprisonment with prison labor for special larceny, etc. at the Incheon District Court, and two years of suspended execution, and on February 5, 2014, the same court was sentenced to four months of imprisonment with prison labor, two years of suspended execution, and six months of imprisonment with prison labor and completed the execution of the sentence at the port prison on March 3, 2016.
[Criminal facts]
1. At night, around December 13, 2016, the Defendant: (a) opened a gate that was not corrected at the victim D’s residence in Gyeyang-gu Incheon, Gyeyang-gu; and (b) stolen the old electric wires equivalent to KRW 25,000 at the market price owned by the victim, who was in custody at the front end of the said house.
2. Intrusion upon residence, theft;
A. On December 15, 2016, at around 16:00 on December 15, 2016, the Defendant: (a) entered the said house with the opening of the gate in the victim F’s residence in Gyeyang-gu Incheon Gyeyang-gu; and (b) invaded the said house; (c) brought a theft of the old electric wires equivalent to KRW 50,000, the market price of the victim’s possession, which was kept adjacent to the rear end warehouse of the said place.
B. On January 10, 2017, at around 15:00, the Defendant: (a) cut the door locks of the above legal branch; (b) carried them into the above legal branch; (c) cut them to cut off, cut off, and cut off the fire fighting locks that were located therein; and (d) cut off the cash 8,000 won, which was owned by the victim.
