A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 13:00 on June 12, 2016, the Defendant posted a notice that the victim D purchases a computer monitor on a four-one-five thousand won-five thousand won-over text message to the victim D, who traded used goods on the Internet. On June 12, 2016, the Defendant sent the victim D a monitor if he/she transfers KRW 145,00 to the victim D through text message.

However, the defendant had no intention or ability to send monitors even if he receives money from the victim D because he received money from the victim D and did not have a monitor.

Nevertheless, as above, the Defendant, by deceiving the victim D as above, received KRW 145,00 from the victim D to the national bank account in the name of the Defendant, and acquired KRW 9,000 in total from around that time to July 12, 2016 by obtaining KRW 2 million from the victims 17 times in total as shown in the attached crime list.

2. On February 17, 2016, the Defendant posted a false statement to the effect that “F will deliver smartphones for 4.50,000 won by using “F”, despite having no intent or ability to sell smartphones,” and that “F will deliver smartphones to the account of community credit cooperatives in H’s name if it transfers the money to the account of community credit cooperatives in H’s name” to the victim G who visited the Defendant.

The Defendant, by deceiving the victim as above, received 340,000 won from the account of community credit cooperatives under the H’s name used by the Defendant on the same day.
