A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. The Defendant and C or a person whose name is not known (one name D or E) have requested C to forge a passport in accordance with due process, and C or E requested C to forge a passport. The Defendant conspired in order to exercise the Defendant’s passport after forging the passport by requesting C or E to forge a new passport.

In March 2001, the Defendant forged official document: (a) delivered a copy of his photograph, etc. to C, to the head of Jongno-gu Seoul, on which he is unable to know the name of Jongno-gu; (b) “I cannot make a passport in the name of another person because it is impossible to have documents necessary for the issuance of the passport at present to leave Japan to punish the money; (c) I would make it impossible to have the passport issued; (d) I would make it possible to leave Korea; and (e) C would give the above two photographs to D or E at that time; and (e) C would issue two copies of the above pictures to the above name D or E; and (e) the above name D or E removed a photograph of the female attached to the passport in the name of the F at that time; and (e) attached the Defendant’s photograph to that name.

Accordingly, the defendant, in collusion with C, the above one-person D or E, forged a passport against the defendant under the name of the Minister of Foreign Affairs and Trade, a public document, for the purpose of uttering.

B. Around April 16, 2001, the Defendant presented a false official document-related passport issued to a public official in charge of immigration control office at the Incheon International Airport departure inspection place located in Jung-gu, Incheon International Airport, Jung-gu, Incheon.

Accordingly, the defendant, in collusion with C, one-person D or E, exercised a forged official document.

2. On April 16, 2001, the Defendant violated the smuggling Control Act departing from Japan outside the Republic of Korea using an aircraft without a passport or other valid proof necessary for departure from the above Incheon International Airport.
