피고인은 2015. 6. 1. 21:03경 용인시 기흥구 언남동 영동고속도로 인천방향 신갈분기점 2.5km지점에서 D 티뷰론 터뷸런스 승용차를 운전하여 가던 중 뒤 따라 오는 피해자 E이 운전하는 F 미니쿠퍼 승용차의 전조등 불빛이 눈을 부시게 하였다는 이유로 화가 나 피해자의 승용차가 피고인의 승용차를 앞질러 가게 한 다음 평소 차량 안에 소지하고 다니던 위험한 물건인 새총에 직경 8mm의 쇠구슬을 장전하여 고속으로 주행 중인 피해자의 승용차의 뒷 부분을 향해 위 쇠구슬을 발사하여 후면유리 교환비용 등 수리비가 886,380원이 들도록 피해자 소유인 위 미니쿠퍼 승용차를 손괴하였다.
