Reasons
Punishment of the crime
1. Defendant A
A. At night, the Defendant: (a) around 00 on August 8, 2014, the lower-class 00:0, the Defendant: (b) cut off the parts of electric wires connected to the power distribution board, and cut off the knife electric wires again; (c) cut off the clothes of electric wires in the knife knife; and (d) cut off the knife at least four times in total, such as theft with 35 km at a 350,000,000 per annum of the market value; (d) cut off the goods owned by the victim, as shown in the attached list of crimes, such as theft with 35 km at a 350,000,000 per annum of the market value.
B. Around 00:10 on December 5, 2014, the Defendant, who attempted to larceny at night buildings, was intruded in excess of a fence to steals electric wires at the victim sian factory, Inc., the victim 1’s instant paragraph (a), but was not discovered by an employee of the guard company called out by the Madern, and did not commit an attempted crime.
2. At around 07:00 on the lower order of August 2014, Defendant B purchased 35 km, which he had stolen from the above A, on the water surface of “H” operated by the Defendant in Nam-gu Incheon Metropolitan City, Nam-gu.
In such cases, the defendant, who operates a secondhand shop, has a duty of care to verify whether he/she is stolen by ascertaining the personal information, etc. of A, while taking into account the details of the acquisition of the former cable, the motive for the sale, and the price suitable for the transaction price.
Nevertheless, the Defendant acquired stolen goods four times in total, as shown in the attached Table 2, by neglecting such care and neglecting the judgment on the stolen goods, by purchasing KRW 350,00,00 for 210,00 and acquiring stolen goods at the price of KRW 2.1 billion.
