A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인과 B은 제주시 오일장에 모이는 사람들 로 하여금 서로 돈을 걸어 윷놀이 도박을 하도록 하고 승리한 사람들 로부터 그들이 건 도금의 10%를 수수료로 받아 나누기로 공모하였다.

그에 따라 피고인과 B은 2016. 4. 12. 14:00 경부터 같은 날 15:30 경까지 제주시 C에 있는 D 공인 중개사 건물 뒤편 이면도로에서 윷놀이 도박을 할 수 있는 자리를 마련한 후 미리 준비한 윷가락, 바둑돌, 종재기 등을 이용하여 E, F 등으로 하여금 도금을 걸고 실제 윷을 던지며 승부를 가리는 속칭 ‘ 선수’ 역할을, G으로 하여금 선수들이 윷을 던지면 그 결과에 따라 말을 놓아주는 속칭 ‘ 말 빵’ 역할을, H으로 하여금 경찰 단속에 대비하여 망을 보는 속칭 ‘ 망 지기’ 역할을 각각 하도록 하고, I, J, K, L 등을 비롯한 그곳에 모인 성명 불상자들 로 하여금 위 선수들을 선택하여 양쪽으로 패를 나누어 각각 도금을 걸고 위 선수들이 미리 준비된 윷을 던져 나온 결과에 따라 말판을 이동하면서 4개의 윷말이 말판을 모두 통과하는 선수의 편이 승자가 되어 베팅한 도금의 배액을 갖게 되는 방식으로 수회에 걸쳐 속칭 ‘ 윷놀이’ 도박을 하게 하여 영리의 목적으로 도박을 개장하였다.
