1. The plaintiff's claim of this case is all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The Defendants, as a husband and wife, supplied the Plaintiff, who runs the wholesale and retail business of sports supplies from around December 10, 201 to March 30, 201, with a “D” amounting to KRW 19,605,670, and supplied the boomer, as the husband and wife, does not have any dispute between the parties.
2. The plaintiff's assertion
A. A. A practical business owner of C and C began transactions by oral agreement and transaction. In light of the characteristics of student sports uniforms produced and sold by using the gas supplied by the Plaintiff, the Plaintiff delayed and supplied them for a period of 1 to 25 days, even though it is possible to sell them to new students, the Plaintiff did not meet the payment period to be set within 20 to 25 days.
The plaintiff's delay in the delivery was caused by the division of the product and the request for the shipment was made, and in the process, 4.6 million won in the case of 13,370 seconds (the "weet" refers to the unit of clothes) ordered on December 15, 201 and 14,717 seconds ordered on November 15, 201.
B. The above delay in delivery 13,370 only 6,107 of the total 6,263 of the total 13,370 and the remainder 7,263 of the total 153,950,000 on the basis of inventory remaining in inventory, and 9,67 of the total 14,717 up to 5,050 of the total 130,280,000 on the basis of inventory remaining in inventory.
In addition, due to the delay in the payment period, it was impossible to sell the sports uniforms of the banks and middle schools due to the change in the design of the sports uniforms of the banks and middle schools that the Defendant intended to deliver.
C. Furthermore, as above, in the case of the above 7,263 arrival of container storage costs, 1,581,749 won per month from April 26, 2012 to March 30, 2013, plus 1,581,249 won per annum for the said 153,90,000 won during the same period, losses of KRW 7,056,041 occurs, and in the case of the above 5,050 arrival, from March 16, 2013 to July 30, 2013, the sum of KRW 561,108 won per month, plus KRW 140,177,280,000 per annum for the storage expenses from March 16, 2013 to July 30, 2013.
