1. The Defendant’s KRW 14,221,076 for the Plaintiff and KRW 6% per annum from February 14, 2013 to June 20, 2014.
Reasons
1. The parties' assertion
A. The Plaintiff’s assertion was not paid KRW 62,70,00 among the agreed construction cost, and KRW 85,207,50,00 among the agreed construction cost, even after having been awarded a contract for construction work with the Defendant for a neighborhood living facility and completed the construction work, and thus, the Defendant is obligated to pay the Plaintiff the sum of the construction cost as above and the damages for delay.
B. The defendant's assertion requires the repair of defects with respect to the portion of the non-construction or erroneous construction performed by the defendant, and the plaintiff completed the above construction work 42 days after the agreed construction period. Thus, the defendant has the damage claim and the compensation for delay in lieu of the above defect repair against the plaintiff, which shall be set off within the same amount as the plaintiff's contract price claim.
2. Determination
A. 1) The conclusion of the instant construction contract and the completion of construction thereof (A) from the Defendant on April 25, 2012, the Plaintiff was each awarded a contract with the Defendant for the construction work of the Native Living Facilities (hereinafter “instant building”) located in Mapopo-si (hereinafter “instant construction”) for the construction cost of KRW 363,00,000 (including additional taxes) and the construction period from May 1, 2012 to August 30, 2012.
② As to the payment of the remainder of the construction price of this case, the Defendant paid the remainder to the Plaintiff by the due date set within 60 days from the date of acquisition of the building of this case.
③ Upon completion of the instant construction, the Plaintiff obtained approval for the use of the instant building from the military market on October 12, 2012, and transferred the instant building to the Defendant around that time.
(B) Details of the additional construction and items for the additional construction of the cost No. 121,6314 each floor water meter for the installation of six-person block-storages and painting works on the left side of the building, which are 4,712,552, 600 left side of the building, and 1,622,8373 building and 6-person block-storages and painting works on the right side of the building.
