1. The Defendant’s KRW 59,247,100 for the Plaintiff and 5% per annum from July 29, 2014 to September 4, 2015.
Reasons
1. Basic facts
A. (1) On April 10, 2012, the Plaintiff entered into a subcontract between the Plaintiff and the Defendant (hereinafter “B”) with respect to the construction of a B factory, the Plaintiff was awarded from the Defendant a subcontract on April 10, 2012 by setting the amount of KRW 87 million (excluding value-added tax of KRW 9.7 million), and the construction period from April 10, 2012 to May 25, 2012 as KRW 1.5/100 of the construction price per day per the construction site.
(2) On April 10, 2012, the Plaintiff was awarded a subcontract from the Defendant on April 10, 2012, with the amount of KRW 70 million (excluding value-added tax of KRW 8 million), the construction period from April 10, 2012 to May 25, 2012, for delay compensation, at KRW 1.5/100 of the construction cost per day per construction site.
(3) On March 2012, the Plaintiff was awarded a subcontract by the Defendant for the construction and extension works of the Time Electric Plant (hereinafter “Time Electric Plant”) at KRW 26 million in the cost of construction of a new factory and waterproof construction works located in Sinsi-dong 1239-3, Sinsi-si, Sincheon-si.
(4) On December 17, 2013, the Plaintiff was awarded a subcontract from the Defendant on December 17, 2013, for the construction work of a factory in the 200-1/100 of the construction cost of a painting construction work among the new construction work of a factory in the 44-8, Seocheon-gu, Nowon-gu, Seoul Special Metropolitan City (Seoul Special Metropolitan City) and KRW 60 million (value added tax separate), from December 17, 2013 to January 30, 2014, compensation for delay was determined and subcontracted as 1/100 of the construction cost per day per the construction site.
(5) On March 2014, the Plaintiff (hereinafter “instant construction”) is value-added tax of KRW 3850,000,000 for the construction cost, among the military storage works in the military unit located in Macheon-si from the Defendant, in the event that all the said construction works are collectively referred to as “military unit works” (hereinafter “instant construction works”).
