A defendant shall be punished by imprisonment for four months.

Punishment of the crime

On December 10, 2015, the Defendant was sentenced to 6 months of imprisonment with prison labor and 300,000 won for larceny, etc. at the Changwon District Court, and completed the execution of the said sentence at the Changwon Prison on January 27, 2016. On May 24, 2016, the Defendant was sentenced to 6 months of imprisonment with prison labor and 300,000 won for attempted larceny, etc. in the Changwon District Court Msan Branch, and completed the execution of the said sentence at the Changwon Prison on September 21, 2016.

On November 21, 2017, the Defendant appealed 10,000 won of imprisonment with prison labor for larceny, etc. and fine of 60,000 won in the Changwon District Court's Msan Branch, and continues to appeal at the Changwon District Court.

1. A thief: (a) around 06:00 on June 11, 2017, the Defendant stolen the “C cafeteria” located in Changwon Mapo-si B; (b) with one national card which the victim D posted on the table.

2. Fraud;

A. On June 11, 2017, at around 08:44, the Defendant received from the victim F of the Victim F in Changwon-si Ma, Changwon-si, Changwon-si services, and the Defendant paid KRW 200,000 of the price with the above national card as if the Defendant was a legitimate licensee of the national card in the name of stolen-do, as described in paragraph 1.

B. On June 11, 2017, the Defendant, at the above G main station around 10:11, received the services of beer and Doer, and the Defendant, as if the Defendant was the legitimate licensee of the stolen-do national card, as described in paragraph 1, settled the amount of KRW 100,000 of the price with the said card and acquired the pecuniary benefit equivalent to the same amount.

At around 12:03 on June 11, 2017, the Defendant received 76,000 won of the price with the said card as if the Defendant was the legitimate licensee of the national card in the name of stolen-do, as described in paragraph 1, at the frequency held by the victim I in Changwon-si, Changwon-si, Changwon-si, Mapopo-si H. In addition, the Defendant paid 1 Sin-si and drinking water, and the Defendant paid 76,000 won with the said card and acquired pecuniary benefits equivalent to the same amount.
