The appeal is dismissed.

The grounds of appeal are examined.

Examining the evidence duly adopted and examined by the lower court and the first instance court, the lower court was justifiable to have determined that the facts charged in the instant case (excluding the portion not guilty) was guilty on the grounds stated in its reasoning.

In addition, there is no error of misunderstanding of legal principles as to the validity of complaints against victim's complaint, misunderstanding of facts as to legitimate acts, incomplete deliberation,

On the other hand, the argument that the court below erred in the misapprehension of legal principles as to the permission of modification of indictment, the scope of trial, and the concurrence of laws is not a legitimate ground for appeal, as alleged in the ground of appeal by the defendant, or by the court below's ex officio.

Even if the record is examined, there is no illegality as alleged above.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
