A defendant shall be punished by imprisonment for not more than ten months.

The defendant shall pay 180,000 won to the applicant for compensation by fraud.

3.2

Punishment of the crime

Around June 18, 2013, the Defendant stated that “I wish to purchase a VAPALUX franchise” on the bulletin board of the Internet’s website “cambing goods” in French site Seoul (hereinafter referred to as Seoul) around June 18, 2013, the Defendant made a false statement to the above victim that “I will sell the franton at KRW 180,000,000,000,000,000 won, and sent money to the new bank E account.”

However, the defendant did not have intention or ability to sell the franchise.

Accordingly, the Defendant, by deceiving the above victim, received 180,000 won from the said victim’s new bank account (F) in the name of the Defendant immediately.

In addition, the Defendant, from the above date to August 14, 2013, received a total of KRW 2,625,000 by deceiving the victims over 12 times in the same manner as in the list of crimes in the attached Form.

On July 31, 2013, the Defendant reported the Victim G G that “I purchase two micro experts” posted on the Internet website on July 31, 2013, the Defendant reads “I purchase two micro experts,” and received KRW 170,000 on the same day from the victim, “I send money to the New Bank H account because I would sell microphones at KRW 170,000,000,000.”

Accordingly, the defendant deceivings the victim to take the property by deceiving the victim.

Around 19:30 on August 15, 2013, the Defendant reported to the victim I’s writing that he/she purchased a fishing boat posted on the Internet NAVVER Kaba on August 15, 2013. The Defendant did not have an intention or ability to sell the boat to the victim despite the lack of intention or capacity to sell it, “I would sell it in KRW 2.80,000,00,000 to the New Bank J account. I received KRW 280,000 from the victim of the same month.”

In this respect, the defendant deceivings the victim to take the property.
