Punishment of the crime

No one shall offer, express an intention to offer, or offer money, goods, or other benefits in connection with the election campaign regardless of the pretext such as allowances, actual expenses, other compensation for volunteer services, or promise, direction, solicitation, mediation, request or receive such offer, and conduct an election campaign before the election campaign period is completed.

1. Defendant A

A. On March 30, 2013, at around 13:00, the Defendant provided F with KRW 500,000 in relation to an election campaign for H candidates run in G-Gun re-election (hereinafter “instant election campaign”) that was scheduled to take effect on April 24, 2013.

B. At around 14:00 on April 17, 2013, the Defendant provided F with KRW 500,000,000 as above, prior to the “J” sales store located in Gyeongnam I.

C. Accordingly, the Defendant’s commencement date of the election campaign period prior to the election campaign period is April 11, 2013, like the foregoing paragraph (a).

At the same time, money and valuables were provided in relation to the election campaign, and money and valuables were provided in relation to the election campaign such as the above paragraph (b).

2. Defendant B

A. On March 23, 2013, at around 13:20, the Defendant provided F with MO car in relation to the instant election campaign, as described in paragraph 1, in “L Real Estate” operated by him/her in K in Gyeongnam.

B. On April 2013, the Defendant provided F with N-E-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W-W

C. At around 20:00 on April 8, 2013, the Defendant provided F with KRW 500,00 in relation to the above election campaign at the place specified in paragraph 2(a).

On April 8, 2013, at around 20:05, the Defendant promised that F will give KRW 100,000 per capita when preparing a list of the applicants for H candidates in relation to the above election campaign before the above H candidates election campaign office.

E. By doing so, the Defendant simultaneously conducts an election campaign prior to the election campaign period, and money and valuables related to the election campaign.
