Punishment of the crime

[Criminal Justice] On July 27, 2012, Defendant A was sentenced to two years of imprisonment with prison labor for a crime of attempted fraud, etc. at the Seoul Central District Court, which became final and conclusive on August 4, 2012, and Defendant B was sentenced to two years of suspension of execution on July 27, 2012 by imprisonment with prison labor for a crime of attempted fraud, etc. at the Seoul Central District Court, and the said judgment became final and conclusive on August 4, 2012.

1. Defendant A

A. Defendant A conspired to obtain a loan as security by forging a lease contract with the lessor on the above apartment, even though he did not have concluded a lease contract with the lessor with respect to the above apartment, as if there was a claim for return of a high amount of lease deposit with respect to the above apartment, as the lease contract for the above apartment exists with E, even though he did not have concluded a lease contract with the lessor with respect to the above apartment.

(1) On January 6, 2011, Defendant A forged Private Document: (a) at the E’s house located in the Young-gu, Young-gu, Suwon-si; (b) upon request from E, Defendant A used the computer to use the computer; (c) stated “E” in the column for location of real estate in the real estate lease agreement; (d) stated “F” in the deposit column, “G” in the phone column, “G” in the phone column, “H” in the lessee’s resident registration number column, “I” in the lessee’s resident registration number column, “J” in the phone column, “B” in the lessee’s resident registration number column, and “A” in the name column; and (d) put the H’s seal created in advance along the above H’s name.

As a result, Defendant A forged one copy of the lease agreement in the name of H, a private document related to rights and duties for the purpose of exercising in collusion with E.

(2) On January 13, 201, Defendant A conspired with Defendant A, at the law firm filial gardens office located in the first floor of the Suwon-si, Youngwon-si, 84-22 legal building at Suwon-si, Seoul-si, and at the same time, Defendant A requested the attorney-at-law in charge of authentication and completed one copy of the forged lease agreement as above.
