피고인은 2015. 2. 28. 13:05경 창원시 성산구 B빌딩 1층 ‘C' 음식점 내에서, 볶음밥을 주문하여 시켜먹은 후 그 테이블에 엎드려 한 시간 동안 잠을 자고 일어나 피해자에게 주문한 짬뽕을 주지 않는다며 억지를 부리며 “야이 개새끼들아”라는 등의 욕을 하면서 테이블을 엎고, 의자를 집어 던지는 등 위력을 행사하여 약 1시간 동안 피해자의 일반음식점 업무를 방해하였다.
