1. 2017. 2. 10. 범행 피고인은 2017. 2. 10. 17:53 경 부산 이하 불상지에서 D 전 대통령의 탄핵을 반대하는 목적으로 만들어 진 네이버 밴드 ‘E ’에 ‘F’ 라는 닉네임을 사용하여, 피해자 G가 태극기를 두르고 있는 사진 6 장 및 불상자가 2015. 4. 18. 경 H 집회에 참석하여 태극기를 불태우는 사진을 연속으로 위 밴드에 게시한 다음 그 아래 “G 는 I 측 간첩으로 떠버리 당 당원! 위에 언급된 스파이들과 한 팀으로 행동함. 태극기를 두르고 E 집회에 나타나 인증사진을 남김. 그러나 태극기에 분 ㄷ을 지르는 모습도 촬영됨. ( 중략) 애국 보수 태극기세력으로 위장해 애국 보수 태극기 세력을 분열 시키고 애국 단 톡 방마다 돌아다니며 깽 판쳐 파괴시킴” 이라는 글을 게시하였다.
