Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment with prison labor for five months.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
Defendants are not narcotics handlers.
1. Joint crimes committed by the Defendants
A. On March 2016, Defendants were smoking marijuana 1 at the “E hotel” guest room located in Gangnam-gu Seoul Metropolitan Government (E hotel), 0.05g of hemps in the hemp machine, attached a smoke generated after being fluencing, and then smoking marijuana in a way of Aarcing.
2) From 00:30 on June 24, 2016 to 05:00, the Defendants smoked marijuana two times in the guest rooms “G hotel” located in F in Jung-gu Seoul Metropolitan Government by inserting the fage of marijuana into the inhalers of marijuana, putting the fage of marijuana, spreading the smoke generated after attaching the fluence, and passing off.
B. From around 00:30 to around 05:00 on June 24, 2016, Defendants: (a) administered philophones on two occasions in the passenger room of “G hotel” 1421 located in Seoul Jung-gu, Seoul, by raising the mecopic volume of the mecopic drug (hereinafter “philopon”; hereinafter “philopon”), which is a local mental medicine, on a gambling ground; and (b) raising the bottom of the mecopon over two occasions by promptly inhaleing it as soon as possible.
2. Violation of the Act on the Control of Narcotics, etc. by Defendant A;
A. On November 2015, the Defendant smoked marijuana by inserting approximately oneg of the two grams of marijuana purchased from I in tobacco around October 2015, in a vehicle parked near the Sungnam-si, Sungnam-si, Mannam-si.
B. On December 2, 2015, the Defendant smoked marijuana by inserting approximately 1g of the 2g of marijuana purchased from I in tobacco around October 2015, in a vehicle parked near H, Sungnam-si, Sungnam-si, and around 06:00.
3. Any person who violates the Act on the Punishment, etc. of Sexual Crimes by Defendant A (use and photographing of cameras, etc.) shall be a camera or any other mechanical device with a similar function.
