1. All appeals filed by the Defendant (Counterclaim Plaintiff) against the instant principal lawsuit and counterclaim are dismissed.

1. Facts of recognition;

A. The Plaintiff is a person who operates an import agency business in the trade name of C, and the Defendant is a person who runs a business of selling and lending futures in the trade name of D.

B. On February 21, 2013, the Plaintiff entered into a series of contracts on behalf of the Defendant to negotiate with the overseas brand head office (Article 2(2)) and deliver a series of services (hereinafter “instant contract”) so that the Plaintiff can be registered as a Korean official designated entity (Offic Retailing Ste) from the overseas database head office that the Defendant designates (Article 2(1) and (2) so as to enable the Defendant to purchase the said brand wale as a wholesale store (Wholese) (hereinafter “instant contract”).

In addition, the common contents of the instant contract are as follows.

Official fees for services related to the registration of designated entities (expenses related to Article 2(1)): 40-70% of the purchase cost of the product shall be applied differently according to the marketing stores and status of overseas brands that the defendant wants to purchase, and the defendant's domestic and overseas market's business performance and awareness.

Expenses related to import agency (Article 2(2)): A certain percentage of the cost of purchase of products, or the cost of request for vicarious collection of goods from prior payment or from Obash pumps, shall be paid 100% or 100% of the cost of communication, and due to the completion of timely preparation in U.S. local areas.
