A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On October 10, 2013, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Seoul Central District Court, and completed the execution of the sentence on May 25, 2014 at the Seoul Detention House.

As above, the defendant was provided with alcoholic beverages equivalent to KRW 4,070,000 by deceiving the victim and acquired them by deception.

1. On January 11, 2017, the Defendant committed the crime at around 01:50 on January 11, 201, 2017, at the “H” main point of the Victim G management in Seongbuk-gu, Seongbuk-gu, Sungnam-si, as if the Defendant were to pay the amount despite the absence of the intent or ability to pay the amount even if he/she orders the alcohol, etc., and was given orders to the victim for Scarchi 2 C, 17 years C, 17 years C, and 17 years C, etc.

Accordingly, the Defendant, as seen above, obtained alcohol equivalent to KRW 700,000 by deceiving the victim.

2. On February 15, 2017, the Defendant committed the crime at around 21:30, Feb. 15, 2017, at “K” entertainment drinking points operated by the victim J in Sungnam-si, Sungnam-si, and at the same time, the Defendant ordered L, who is an employee of the said main shop, to pay for the amount despite the absence of the intent or ability to pay the amount, even if he/she orders the alcohol, etc., and received orders such as Scarblu 17 years and around 5 years and worth.

Accordingly, the Defendant, as seen above, obtained alcohol equivalent to KRW 2,170,000 by deceiving the victim.

[2017 Highest 3993] On February 14, 2017, the Defendant completed the following: (a) at the “O” entertainment shop for the victim N’s 1st floor located underground in Sungnam-si, Sungnam-si, Sungnam-si; (b) even when ordering alcohol, etc., the Defendant did not have the intent or ability to pay the price.
