피고인은 2011. 5. 31. 23:25경부터 같은 날 23:55경까지 경기 시흥시 B에 있는 피해자 C이 운영하는 'D주점'에서 술에 취한 상태에서 술값을 내기로 한 일행이 돌아오지 않는다는 이유로 화가 나 피해자에게 “이 씨발년아, 좃 같은 년아, 개 같은 년아”라고 큰소리치고, 위 가게 안의 손님들에게 욕을 하면서 술 마시는 것을 방해함으로써 위력으로 그녀의 치킨집 영업 업무를 방해하였다.
