Defendant shall be punished by a fine of KRW 3,000,000.

Reasons
Punishment of the crime
At the time of the 17th National Assembly election, the Defendant sent out to the Gu D Party candidate in the 18th National Assembly election. At the time of the 18th National Assembly election, the Defendant was engaged in political activities in the said constituency, such as registering as the same party candidate in the same constituency at the time of the 18th National Assembly election. During the 16th National Assembly election as well as the 17th National Assembly member in the said constituency, the Defendant had access to the 16th and 17th National Assembly member in the above E SNS website and was aware that E was engaged in public relations activities by registering as the preliminary party candidate and registering as the 20th National Assembly member in the 20th National Assembly member election.
On March 7, 2016, at around 22:39, the Defendant, using the Defendant’s mobile phone in the neighboring park in Dongdaemun-gu Seoul Metropolitan Government H Defendant’s residence, posted a statement on the SNS page of the SNS candidate for E, and posted it on the SNS page, stating, “I am again from the person who am dys down, dypine, and dyp human being, with dypine and dypine dypine dypine dypine, after having dypineed or obtained dypylly and dypine dypine, as in the year.”
However, in fact, I, the father of E, from September 2008 to June 2009, was hospitalized in Tol University Seoul, Seocho-gu Seoul, Seoul, and died on June 8, 2009, and due to the death of his/her family members such as J and E, etc., E, the father of E did not have abandoned or neglected the father of the year.
Accordingly, the Defendant published false facts about the preliminary candidate to be disadvantageous to the preliminary candidate in order to prevent E, a preliminary candidate for the 20th National Assembly election, from being elected.
