A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On November 22, 2014, at around 23:30 on November 22, 2014, the Defendant driven a C low-speed car with a blood alcohol concentration of about 0.178% in the four kilometers from the Incheon International Airport located in Seogdong, Incheon, to the shooting distance from the third intersection, located in the middlewest coast of Jung-gu, Incheon.

2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving a C low-speed car.

On November 22, 2014, at around 23:47, the Defendant: (a) driven the said car under the influence of alcohol to the extent of 0.178%; (b) while driving the said car at the speed of 122 km (80 km at a speed) at the speed of 122 km (80 km at a speed) from the surface of the airport New Airport, while driving the said three-lane road at the speed of 122 km (80 km at a speed) from the surface of the airport, while driving the said three-dimensional road at the speed of the victim D (24 km at a speed) who stopped under subparagraph (c) of the said subparagraph, the lower part of the broadband truck was driven by the front part of the Defendant’s vehicle; and (c) caused the said cargo to stick off the said vehicle.

As a result, the Defendant driving a motor vehicle under the influence of alcohol and caused the death of the victim H (24 years of age) who is the passenger of the said cargo vehicle, by driving the motor vehicle in a state that it is difficult to drive the motor vehicle normally. On December 28, 2014, the instant victim D caused the death of the victim H (38 years of age) at the Acheon-ro Hospital due to cerebral cerebrovascular surgery. The said victim D requires the victim D to provide approximately seven weeks of medical treatment, such as the right-hand spathy, and the victim I (24 years of age) who is the same vehicle to provide approximately twelve weeks of medical treatment, and the victim J (23 years of age) who is the passenger of the same vehicle to provide approximately six weeks of medical treatment.
