Among the judgment of the first instance, the part against the defendant exceeding the amount ordered to be paid under the order shall be revoked.
Reasons
1. Basic facts
A. On February 25, 2005, the Plaintiff entered into an insurance contract with the Defendant on February 25, 2005 with the beneficiary, other than the insured and death insurance (hereinafter “No. 1”) (hereinafter “No. 2 insurance”) and the D Insurance (Type 1-1) on July 20, 207 (hereinafter “No. 2 insurance”).

The first insurance is an insurance product that pays insurance money for more than 3 days and more than 30,000 won per day to the extent of 120 days in the event of hospitalization for more than 4 days, and the second insurance is an insurance product that pays more than 3 days and more than 50,000 won per day to the extent of 120 days in the event of continued hospitalization for more than 4 days. According to the terms and conditions of the second insurance, the term “major sexual disease” includes the case which is diagnosed as knee-vise-vise-vis (M23), and other shree-vise-vise-vis (M13).
C. From December 30, 2016 to January 14, 2017, the Plaintiff was hospitalized in Ansan-si E Hospital located in Ansan-si, and received medical treatment, such as “the spatical anti-spatical anti-satissive anti-satissive anti-satiss and satissive anti-satissatis,” and the Defendant paid insurance proceeds.
The Plaintiff discharged from the E hospital, re-hospitalized at the F Hospital located in Ansan-si on the same day, and was discharged from the hospital under the following diagnosis for 49 days until March 3, 2017. From June 26, 2017 to July 18, 2017, the Plaintiff received hospitalized treatment at the G oriental medical hospital located in Ansan-si for 23 days from Jun. 26, 2017:
