1. On the Plaintiff (Counterclaim Defendant),
A. Defendant (Counterclaim Plaintiff) B and Defendant C are real estate listed in the separate sheet No. 1.
Reasons
A principal lawsuit and counterclaim shall also be deemed a principal lawsuit and counterclaim.
1. Facts of recognition;
A. On September 10, 2012, the Plaintiff entered into a lease agreement with Defendant B as to the real estate listed in paragraph (1) of attached Table 1 (hereinafter “building 1”), with a deposit of KRW 30 million, a lease of KRW 4.5 million per month, a lease of KRW 4.5 million per month (hereinafter “lease”) under a lease contract between the Plaintiff and the Defendant (hereinafter “lease 1”) and a lease contract with the term of September 29, 2017, and a contract with respect to the real estate listed in paragraph (2) of attached Table 2 (hereinafter “building 2”), a deposit of KRW 10 million, a lease of KRW 3 million per month, and a lease of KRW 3 million per September 29, 2017. At that time, the Plaintiff received each of the above deposits from Defendant B and delivered the building 1 and 2.
Each of the above lease agreements included a special agreement that the plaintiff, a lessor, consents in advance to sublease by the defendant B, who is the lessee.
B. On October 16, 2012, Defendant B entered into a sublease contract with Defendant C as between KRW 200,000,000 per deposit and KRW 8,500,000 per month for the sub-lease (hereinafter “sub-lease loan”) and the contract period from October 31, 2012 to October 30, 2013 with respect to the sub-lease (hereinafter “sub-lease”) and the sub-lease contract between Defendant C and Defendant D as between November 5, 2012, between KRW 10,50,000,000,000 for the sub-lease and the contract period, from November 30, 2012 to November 29, 2013, Defendant C and Defendant C were delivered around that time.
C. Defendant E is currently operating a new store in the first and second buildings with the consent of Defendant C (E) and Defendant D (A director of a company operated by Defendant E).
Defendant B did not pay the Plaintiff the rent for the first building from September 5, 2013 for the second building, and from October 1, 2013 for the second building, the Plaintiff’s first and second buildings on this ground.
