A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

피고인은 2015. 3. 27. 20:30경부터 같은 날 23:10경까지 시흥시 C아파트에 있는 피고인의 주거지에서, 아내인 피해자 D이 피고인 모르게 피고인 명의로 대출을 받고 피고인이 피해자에게 맡겨둔 통장 비밀번호를 바꾼 문제로 말다툼을 하던 중, 피고인이 피해자에게 이혼하자고 말하자 피해자 또한 “그래 나도 더 이상은 못 살겠다”고 말했다는 이유로 화가 나, 작은 방에 있던 유선전화기의 전화선을 피해자의 목에 감고 피해자를 바닥에 쓰러뜨려 눕힌 후, 피해자의 배 위로 올라 타 “죽여버리겠다, 나 유서 써 놨다, 오늘 끝장낸다. 너 죽이고 나도 죽인다, 니가 내 어머니와 누나 모신 것은 감사하고 저승에서 만나자”고 말하면서 양손으로 위 전화선을 수회 세게 잡아당겨 피해자의 목을 졸라 피해자를 수회 기절시키고, 피해자가 울면서 “살려 달라”고 말하다가 팔과 다리를 늘어뜨리면서 기절하면 피해자의 목에 감고 있던 전화선을 느슨하게 풀어주다가 다시 피해자에게 욕설을 하고, 피고인이 마시던 술을 피해자의 얼굴에 뿌리고 주먹으로 피해자의 얼굴을 수회 때린 후 다시 양손으로 피해자의 목을 세게 조르기를 반복하여 피해자에게 약 2주간의 치료를 요하는 안면부 좌상 등의 상해를 가하였다.
