A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. From around 23:30 on July 19, 2013, the Defendant driven a B mae-car under the influence of alcohol concentration of about 0.067% without obtaining a driver’s license in the section of about 2km from the vicinity of the KBS Main Station located in Yeongdeungpo-gu Seoul Metropolitan Government to the front road of the future model located in Yeongdeungpo-gu, Seoul Special Metropolitan City to Sucheon-dong 725-4.
2. When the Defendant committed a violation of the Resident Registration Act by drinking under paragraph (1), the Defendant was at the time when the Defendant was in force due to drinking under the influence of alcohol, and the Defendant was at the time when the Defendant was in force due to drinking under the influence of alcohol, with C’s name, resident registration number, etc., which was known to the Immigration Office before four to five years, to have the Defendant committed as if the Defendant was C.
On July 19, 2013, when no one unlawfully uses another person's resident registration number, the defendant was found to drive under drinking on the front of the future Washington factory located in Dobong-dong 725-4, Gwanak-gu, Seoul Special Metropolitan City, and requested a police officer D to present a driver's license or a certificate equivalent thereto, and received inquiries for the driver's identity and confirmation of the driver's license, and notified the police officer of the above control E, a resident registration number of C, without authority, while driving as C, while informing the driver of the above control police officer.
Accordingly, the defendant used C's resident registration number unlawfully.
3. Forgery of private documents;
A. On July 19, 2013, the Defendant: (a) written “C” and “E” in the form of a written statement that was kept in the office of the Seoul Gwanak-gu Seoul Special Metropolitan City Nowon-gu Police Station traffic safety department; (b) recorded “C” and “E” in the resident registration number column; and (c) recorded “E” at the bottom of the written statement on July 19, 2013.
