Punishment of the crime

[2] Defendant A is the representative director of Defendant D, a company located in Seo-gu Daejeon, Seo-gu, Daejeon, who has overall control over the business of raising investors and managing funds. Defendant B is the total liability of the company's Daejeon area. Defendant C is a higher-tier investor and is in charge of raising investors.

The Defendants intended to invite investment to many and unspecified persons and to attract investment money by paying allowances to persons soliciting subordinate investors.

1. The joint criminal conduct of Defendants B and C shall not engage in any activity that is engaged in the business of raising funds from many and unspecified persons without obtaining authorization, permission, making registration, reporting, etc. under other Acts and subordinate statutes, and the payment of the total amount of investment or the amount in excess thereof shall not be made in the future;

around February 2, 2017, the Defendants conspired with A, and explained that “D is engaged in the business of selling the walk for investors, including G, at the D office, with the feed manufactured at the Haak-si farm located in Chungcheongbuk-do. The 1st unit of D is KRW 1,00,000,000 per day until after one week to 1,300,000 won. When joining the 1st unit, the Defendants would pay KRW 40,000 per day until 1,30,000 won.” On the same day, the Defendants received KRW 5,00,000 from G as investment money, from that day to March 10, 2017, the Defendants received KRW 67,000 in total from investors as shown in the attached list of crimes.

As a result, Defendants are engaged in the business of raising funds from many and unspecified persons without obtaining authorization or permission under Acts and subordinate statutes or making registration or report, etc.
