가. 2015. 4. 27.자 공무집행방해 피고인은 2015. 4. 27. 22:30경 위와 같은 장소에 신고를 받고 출동한 순천경찰서 C지구대 소속 경사 피해자 D 등이 “나는 택시기사를 폭행한 적이 없다.”고 말하며 범행 현장을 이탈하려는 피고인을 교통사고의 위험성이 있다고 판단하여 횡단보도 방향으로 이동시키려고 하자 위 D의 멱살을 잡아 흔들고, 경찰관들에게 “씹할 놈들아, 좆밥 새끼들아, 나랑 일대일로 붙자”고 말하며 오른 발을 위로 들고 위 D의 발등을 3회 가량 내리찍어 폭행하였다.
